The law does not automatically give your spouse the right to handle your financial and medical affairs if you are incapacitated.
Your spouse also does not have the right to get your medical information if you cannot give such consent yourself.
For these and many other reasons, it is essential that you take steps to protect yourself and your loved ones by having a thorough estate plan,
usually including a Will or Trust, a Medical Power of Attorney, Power of Attorney for Property, Living Will, HIPAA Release and a Declaration of Last Remains.
